Currently, there are seven class action lawsuits that have
been filed and are active against the cell phone
manufacturers. In the fall of 2005 five of those cases were
reviewed by the Supreme Court as the cell phone industry
asked for the cases to be dismissed. The Supreme Court
however ruled that there was enough evidence for the cases
to move forward. Those cases are currently in the active
process of working their way through the legal system. In
addition, there are numerous active individual cases that
have been filed where brain cancer development has allegedly
occurred due to cell phone use.
One workman’s compensation case in California has already
been ruled in favor of the plaintiff. The court ruled that
there was substantial evidence that the plaintiff’s brain
tumor had been caused by excessive use of the cell phone in
her line of work. She won her petition. No doubt this will
set an important precedent in cases to follow.
